Terms & Conditions

The terms that govern this website and any digital marketing services you engage Orbilox to provide.

Last updated: 17 September 2026

This document explains how Orbilox operates in plain terms. It is not legal advice. If you need it to satisfy a specific regulator or contract, have a qualified lawyer in your jurisdiction review it before you rely on it.

01

Agreement to These Terms

These Terms & Conditions govern your use of orbilox.com and any digital marketing services you engage Orbilox to provide. By using this website, requesting a proposal, or engaging us for work, you agree to these terms.

Where you sign a separate proposal, statement of work or service agreement with us, that document takes precedence over these terms wherever the two conflict.

02

Our Services

Orbilox provides digital marketing services including, but not limited to:

  • Search engine optimisation (SEO), including local and technical SEO
  • Paid advertising management across Google, Meta and other platforms
  • Content marketing and copywriting
  • Social media management
  • Web design and development
  • Conversion rate optimisation and analytics

The specific services, deliverables, timelines and fees for your engagement are set out in your proposal or statement of work. Anything not expressly described there is out of scope.

03

No Guarantee of Rankings or Results

Search engines and advertising platforms control their own ranking and delivery algorithms. Those algorithms change without notice and are outside our control.

We do not guarantee any specific ranking position, traffic volume, lead count, conversion rate or revenue figure, and you should treat any such guarantee from any agency with caution. Where we reference past results — including case studies on this website — those describe outcomes for specific clients in specific circumstances and are not a prediction of your results.

We commit to applying professional skill and industry-accepted practice. We do not use techniques that violate search engine or platform guidelines.

04

Your Responsibilities

Effective delivery depends on your cooperation. You agree to:

  • Provide timely access to websites, hosting, analytics, advertising accounts and any other systems we need
  • Supply accurate information, content, images and approvals when requested
  • Hold the necessary rights to any material you provide to us
  • Respond to requests for feedback or approval within a reasonable period
  • Not make undisclosed changes to work we are managing, where those changes may affect results

Delays caused by outstanding access, content or approvals will extend delivery timelines accordingly and may affect campaign performance.

05

Fees and Payment

Fees, billing frequency and payment terms are set out in your proposal. Unless stated otherwise, invoices are payable within 14 days of the invoice date.

Advertising spend is separate from our management fees. Where you fund advertising through accounts we manage, that spend is billed by the platform directly to you, or recharged at cost, as set out in your proposal.

We may suspend work on overdue accounts after giving written notice. Suspension does not relieve you of fees already incurred.

Fees are exclusive of GST, VAT and any other applicable taxes unless expressly stated.

06

Intellectual Property

On full payment of all amounts due for a deliverable, ownership of that deliverable — such as written content, designs and code produced specifically for you — transfers to you.

We retain ownership of our pre-existing materials, methodologies, internal tools, templates and know-how, including anything developed before or independently of your engagement. Where these are embedded in a deliverable, you receive a perpetual, non-exclusive licence to use them as part of that deliverable.

Unless you tell us otherwise in writing, we may reference your business name and describe the work in our portfolio and marketing materials.

07

Confidentiality

Each party may receive confidential information from the other — including business plans, pricing, customer data, analytics and account credentials. Both parties agree to keep such information confidential, to use it only for the purposes of the engagement, and to protect it with reasonable care.

This obligation does not apply to information that is already public, independently developed, or required to be disclosed by law.

08

Third-Party Platforms

Our services rely on third-party platforms including Google, Meta, Microsoft, hosting providers and analytics tools. Each is governed by its own terms, which you are responsible for complying with in respect of your accounts.

We are not responsible for changes to, outages of, suspension of, or decisions made by those platforms — including account suspensions, ad disapprovals, algorithm updates or pricing changes.

09

Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with your engagement is limited to the fees you paid us for the services giving rise to the claim in the three months preceding the claim.

We are not liable for indirect, incidental, special or consequential loss, including loss of profits, revenue, data, goodwill or business opportunity, however arising.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including under the Australian Consumer Law or equivalent consumer protection legislation in your jurisdiction.

10

Term and Termination

Either party may terminate an ongoing engagement by giving 30 days' written notice, unless your proposal specifies a different notice period or a fixed minimum term.

Either party may terminate immediately if the other commits a material breach and fails to remedy it within 14 days of written notice.

On termination you remain liable for all fees for work performed up to the termination date. We will provide reasonable assistance to hand over access, files and account ownership.

11

Use of This Website

The content on orbilox.com is provided for general information. We make reasonable efforts to keep it accurate but do not warrant that it is complete, current or error-free.

You may not scrape, republish, resell or systematically copy content from this website without our written permission, or use it in any way that interferes with its operation or security.

12

Governing Law

These terms are governed by the laws of India, and the courts of India have non-exclusive jurisdiction over any dispute arising from them.

Where you engage us in Australia, the United States or Singapore, nothing in this clause removes any non-excludable consumer right available to you under local law.

Before commencing proceedings, both parties agree to attempt in good faith to resolve any dispute through direct discussion.

13

Changes to These Terms

We may update these terms from time to time. The version published on this page at the time you engage us applies to that engagement. Material changes affecting an ongoing engagement will be communicated to you directly.
